This Agreement (the “Agreement”) is entered into as of 26 January 2026, between Ashghal Public Works Authority (“Ashghal”), referred to as “the Authority”, and , a company registered in the State of Qatar, referred to as “the Second Party”.

Purpose and Scope

1.1 Purpose

The Authority is committed to maintain the highest standards of performance, quality, and governance in the execution of its projects. This Agreement establishes a formal framework to ensure that the Second Party adheres to these standards through measurable performance outcomes, transparency, and compliance with the Authority's policies.

1.2 Scope

This Agreement shall apply to all current and future parties engaging in projects with the Authority, including but not limited to:

  • Participation in any tender processes initiated by the Authority.
  • Execution of any project(s) awarded by the Authority.
  • Ongoing collaboration and service delivery under existing contracts.

1.3 Mandatory Requirement

Execution of this Agreement is a mandatory prerequisite for the Second Party's prequalification, participation in tenders, and the award of any contract by the Authority.

Definitions

For the purposes of this Agreement, the following terms shall have the meanings set forth below:

KPI
Key Performance Indicator — the mechanism against which the Authority measures the Contractor's execution of the Works.
NTC
Notice to Correct — a notice given by the Engineer to the Contractor to remedy a specified default or failure in the performance of any obligation under the Work Order.
NoDE
Notice of Default Event — for the purposes of the Work Order, a default event shall comprise any breach by the Contractor of its obligations under the Work Order, all of which shall constitute breaches.
LTE
Lost Time Event — an incident arising out of or in the course of work which results in an injury or illness that prevents a worker from returning to work on the next scheduled shift.
Performance Score
The numerical value assigned to the Second Party based on the evaluation methodology set forth in Section 3.
Poor Performance Notices
Count of formal warnings regarding substandard delivery.
Contract Termination(s)
Number of contract(s) terminated for cause over the last five (5) years.
Disqualification(s)
Number of disqualification(s) from tenders or projects over the last five (5) years.
Legal & System Compliance Failures
Failure to comply with plans, systems, and/or law as stipulated in the workorder contract.
Staff Mobilization
Timely mobilization of Key Staff as per workorder contract.
Staff Availability
Continuous presence of Key Staff (excluding approved leave).

Performance Criteria and Evaluation Methodology

The Second Party's performance shall be evaluated based on specific criteria measured against defined metrics that contribute to an overall Performance Score, and the scoring shall be calculated at the contract level. Each contract will be weighed according to its value relative to the contractor's total portfolio of contract values to calculate the total performance score.

3.1 Evaluation Frequency

Performance evaluations shall be conducted quarterly for active projects, with a comprehensive annual review to determine the Second Party's overall performance rating.

3.2 Impact of Performance Rating

The cumulative score derived from the above matrix will determine the Second Party's Contractor/Consultant Performance Rating as follows, together with the resulting actions:

≥ 85%
EXCELLENT
  • Participation in future tenders
  • 5 points added to future tender technical evaluation scoring
65–84%
GOOD
  • Participation in future tenders
  • 2 points added to future tender technical evaluation scoring
< 65%
POOR
  • Recommendation for temporary suspension of the Contractor due to unsatisfactory performance
